without modification or revision. Krystalline Himalaya (“K-line”) may amend, revise or update these Terms at any time and without prior notice to you. All content on the K-line website, such as text, audio and video clips, button icons,
digital downloads, logos, graphics, data compilations, images, photography and software, is the property of K-line and is protected by international copyright laws. The content and compilation of this site is the exclusive property of K-line and is protected by international copyright laws. The K-line website, whether in part or in it’s entirely, may not be copied, reproduced, visited, sold, duplicated, resold, or exploited for any commercial purpose without written consent from K-line. Meta tags or any other "hidden text" utilizing the K-line trademarks or name cannot be used without written consent. Additional trademarks on this website that do not belong to K-line remain the property of their respective owners, who may or may not be affiliated with K-line.



Travel Policy Terms & Conditions

Please review the following Travel Policy Terms and Conditions (“Terms”) and sign in the space provided at the bottom of each page. When your Trip with Krystalline Himalaya (“K-line”) begins, you will be asked to sign (with a witness present), the Participant Agreement Release and Liability for Risk (“Agreement”), which is available upon request and also on our website. These Terms will dictate your adventure with K-line. Any Client (“Client”) booking a Trip with K-line must sign these Terms prior to departure. “Trip” is defined as the moment when the Client leaves his/her home to travel to the airport in order to travel to India, to the moment when he/she arrives at home at the end of the journey.

The Agreement and the Terms (below) form the exclusive agreement in it’s entirety between the Client and K-line. No modification, waiver or termination thereafter is permitted by the Client, unless signed in writing by the Client and by K-line. K-line may amend, revise or update these Terms at any time and without prior notice to the Client, however, in such rare circumstances that Client will be notified of the change.

Reservation & deposit payment guarantee
All reservations through K-line requires payment by either wiring the funds to a K-line bank
account, or by credit card through Paypal. All credit card payments are directed through secure access by Paypal to ensure the safest online payment method. K-line does not hold or have access to your sensitive credit card details.

Privacy
K-line holds all client information for the purpose of updated customer details and does not
share this information with any other party. As stated above, credit card information is held by Paypal – K-line does not have access to the Client’s credit card details.

Currency
All rates published and referred to by K-line are in United States Dollars (USD) and fixed.
K-line reserves the right to change and all rates without prior notice to the Client, although the Client will be notified of such changes.

Cancellation & changes policy
Any cancellation by the Client results in forfeit of the payment made for the Trip. In the event
of serious personal issues, health issues or poor weather Conditions, it is at the discretion of K-line to offer any type of refund, extension or alteration of the dates of the Trip.

K-line reserves the right to accept or refuse any requested changes to the Trip, such as duration or dates. In the event that K-line accepts such changes, the Client is responsible for all additional costs arising from these changes.

If K-line makes a mistake in relation to the Trip, K-line will bear all costs and responsibilities to change the Trip as required, or reimburse the Client. If a cancellation made by K-line is not cause by external factors outside of K-line’s control (e.g. weather), the Trip will be rescheduled or the Client reimburse as deemed appropriate by K-line.

Insurance
The Client is responsible for all travel insurance for the entire Trip. K-line will ask to see
evidence of travel insurance for the whole duration of the Trip. K-line is not responsible for any costs or inconveniences after the cancellation of the insurance policy, but before the end of the Trip. If evidence of insurance is not provided, K-line reserves the right to delay or cancel the Trip without refund.

K-line requires that the Client purchases insurance that covers medical expenses, personal accidents and air ambulance. K-line also recommends insurance for the loss of possessions, Trip cancellations and delays, as well as any additional expenses resulting from any inconveniences experienced by the Client. K-line is not responsible for Trip cancellations, delays or the loss of possessions, whether the Client does or does not purchase necessary insurance. K-line takes no responsibility in any disputes occurring between the Client and his/her insurance company.


Road Policy Terms & Conditions

Services not covered
Additional activities and/or services may be offered by K-line during a Trip. The Client will be
responsible for all additional costs incurred due to the partake of such services/activities. Only the activities and services specified on the reservation confirmation or e-mail are encompassed in the cost of the Trip.

Price adjustments
K-line reserves the right to adjust the price of a Trip after payment is made, if changes deemed
significant by K-line occur in transportation costs, airfare, taxes, fees, exchange rates or any costs resulting from Government action. The Client will be responsible for any such increases in cost that are outside the control of K-line. It is at K-line’s discretion to determine what portion of the increase should be borne by the Client and what portion should be borne by K-line.

Changes to itinerary
Although K-line will make every effort to honour the agreed-upon itinerary, inevitable changes
may occur due to, but not limited to, unforeseen circumstances such as weather conditions, mechanical breakdowns, accidents, sickness or Government issues.

K-line will make every effort to provide the services that are communicated to the Client as part of the itinerary, but K-line reserves the right to make additions, omissions or changes to the itinerary, as deemed appropriate by K-line. The Client will be informed of such changes before departure as soon as possible and issued a refund as deemed appropriate by K-line.

The Client is permitted to make alternations to the itinerary, services and dates of the Trip, at the discretion of K-line. The Client is responsible for any increases in price as a result of requested changes.

Safety & laws
For the Client’s safety, Mountain Guides’ decisions are final on all matters. The Client must
abide by all laws of the countries visited during the Trip. K-line reserves the right to cancel the Trip and/or dismiss the Client, should any violation of the law be deemed serious enough,. Any actions thus taken by K-line will not result in a refund.

The Client acknowledges that he/she is in good physical and mental health and does not have any medical conditions that may hinder or impede any activities undertaken on the Trip. The Client acknowledges that he/she skies/snowboards/hikes at a level that is appropriate to the level of activity undertaken (advanced for backcountry, intermediate for off-piste and beginner/intermediate for ski runs).

K-line takes no responsibility for any accidents and inconveniences, or any damages caused to the Client’s person or possessions, that may occur during the Trip.

Travel
The Client must have a valid passport, visas, appropriate vaccinations and any other
necessary documents for travelling on this Trip. K-line does not assume responsibility for any of the aforementioned items. Any travel information or advice provided by K-line is provided in good faith, but K-line assumes no liability in providing this information.

Airlines
K-line is only responsible for booking flights between India and Kashmir and not for the carriage
of Clients or any delays and inconveniences. Issues involving the airline or the flight must be resolved between the Client and the relevant airline only. K-line makes air travel arrangements in good faith, but is absolved of liability and responsibility regarding these arrangements.

Video & photography release
I permit K-line and other K-line Clients to take images, film and digital records of the Trip
without liability. I authorise K-line to use all photography, film and imagery for commercial reasons.

Equipment
K-line may rent, lend or hire equipment and/or clothing to the Client during or after the Trip.
K-line is not responsible for any consequences arising from the misuse of such equipment by the Client, or for any malfunction and breakage of such equipment due to manufacturing or environmental factors.

Should the equipment be damaged, K-line reserves final rights in determining if and how much the Client must compensate for the damaged/lost/stolen equipment, with the compensation deducted directly from the deposit for the goods. The Client is responsible for tax, shipping and other costs relating to the damaged, missing or stolen equipment.

K-line takes no responsibility for any accidents and inconveniences experience by the Client, or any damages external to the Client, caused by the use of such equipment.

By visiting our website, you accept the policies documented in this Privacy Policy and your continued use of this website after changes have been implemented constitutes your acceptance of such changes. Information that personally identifies you is collected when you use the K-line website, including information that is explicitly provided to us by you, as well as information, such as your IP address, that is automatically gathered when you use our services. You hereby authorize us to use your personal information to provide you with travel details, responses to trip requests, or to personalize any communications you consent to receive, electronic or otherwise.

The K-line website may contain links to other websites, which in turn, may contain hyperlinks
to websites operated by third parties. K-line does not control any of the above websites and takes no responsibility for the content or for any breach of control or any intentional or negligent action on the part of such third parties, which may result in any damage, loss, injury or delay to you or anyone who may be associated with you. K-line takes no responsibility for the accuracy of opinions on such websites and furthermore, these websites are not monitored, checked or investigated for completeness, accuracy or integrity. If you decide to leave the K-line website to access these third party sites, you do so at your own risk. All policies (including privacy policies), rules and operating procedures of websites operated by third parties will apply to you while on such sites. K-line is not responsible for information provided by to you third parties.

Booking tools
K-line may cooperate with third parties or elect to provide third-party links in order to give you
access to online booking tools. These online booking tools are operated and owned by third parties and K-line is not liable for their operation or for any information provided to you. These tools may obtain information (financial and otherwise) from you that is personally identifiable in order to complete their booking requests.

Third party privacy policies
Paypal and other third parties we share your personal information with may have their own
privacy policies regarding the use of their websites. We strong encourage you to read those privacy statements. The K-line Privacy Policy does not apply to these third parties and their policies may differ from that of K-line. K-line takes no liability regarding the privacy policies or practices of linked websites, partners, vendors or any third parties.

Log files
K-line uses log files to track user and system activity, which include IP addresses, ISP, browser
type and other technical information regarding your use of our website. This information is used by K-line observe trends, manage the website, analyze use movements and patterns and as a whole, to gather information for overall use.
